Any thoughts? Gaining plenty of traction on social media. White-Gluz and Gossow come across as complete shites, but I guess that's hardly breaking news.

I think this is all part of a bigger problem with copyright which probably needs addressed at some point. It seems the photographer is legally in the right, but I can see the argument from both sides.

It's his photograph, so it's his work and therefore he should hold the rights to it and any profits
It's also a photograph of a performer doing their job, so I can see why the band think they shouldn't have to pay for it

With digital media everything gets passed around and shared so a lot of people copy things and post it on their site. It's just a bit shit how it's only the big companies who really get to enforce their rights (e.g. YouTube automatic takedowns  which are almost impossible to appeal even if they're incorrect).

It also seems to be a "retweet" or whatever the instagram equivalent is, rather than the company full on stealing the image and claiming it as their own. I dunno how I feel about the whole thing, but it definitely could have been handled better.

Anyway, enough of my incoherent rambling...

It sounds like the photographer is a bit of a chancer to be honest and his youtube video is fucking nauseating. The hysterical voiceovers to characterise and demonise the AE responses are worthy of Fox News. I'm not a fan of AE by any stretch but I am entirely sympathetic with them on this one. I'm sure he pays any artist whose image he uses to further his own ambitions, yeah?

Personally the photographer was completely in the right. A company used his work as advertising.  Arch Enemy have been shit for years, so have no idea why I spent time reading about it either  :laugh:

This really should have just been between the photographer and the clothing company, and it was the clothing company that sent it straight on to AE instead of trying to sort it out themselves.

Then the reaction from Gossow really just put the band in a shitty light,when they should have simply stayed out of it

I don't see it as clear cut as the company simply stealing the photo for advertising.

The photographer posted the photo, the band used the "share" functionality and said "look at me", and then the company shared it again saying "look at her, she's wearing our stuff!".  That's how a lot of stuff on social media works.

It'd be different if the company deleted the photographer's logo, added their own logo and the text "BUY OUR BELTS! ONLY $20 AT SHOP.COM!"

But still, shitty responses all around.

Think thats the crux of it right there. The minute you add a photo to a social media platform you are broadly licensing that platform, and more importantly its users(!), to share that content.

Now if the image was taken by a third party and uploaded elsewhere (another platform, their own website etc.) or used in print/another format - that would be entirely different. This clueless idiot has no idea how social media works or the world works. That was a missed opportunity to talk with the clothing company about licensing high res images for a print catalogue or their website - not to send out a begging letter.

It's an interesting pointabout photographers though - yeah, they spend time taking photos with expensive equipment they've bought - but without the subject matter (a cool looking and famous band) what are they really? over entitled wanna bees with delusions of grandeur a lot of the time.

Think the story has become just another vehicle to casually bash a band even subtle digs from the photographer calling them alleged anarchists and what not towards the end of the post to kick things off. I've probably seen more traction from this than the Josh Homme photographer run in and she got kicked in the head!   ;D

It's a hobby for many of these photographers, he notes he doesn't do it full time but is sticking up for his peers well those lucky enough to be able to do it full-time just shooting shows I gather there isn't many and those in those positions have built up relationships with venues,promoters maybe even artists not some freelancer shooting for a niche website no one heard of before yesterday, I'd say the site never saw as many hits over this.

Credentials for covering events by people who are into that sort of thing aren't meant to be that hard to acquire that may not be so easy down the line, spoke to a guy at Wacken before who was basically an attendee with a pro camera, he bragged that he couldn't believe his luck his application was accepted and how stupid could they be.

Arch Enemy have never actually never laid down any restrictions for photographers, dozens of artists won't let personnel to a photo-pit unless they sign all their rights to the images away contractually mentioned briefly in vid, others will have clauses the likes of an escort following your every move, no publishing photos until work is assessed I see the likes of that getting ramped up. I see the clothing company are after shutting down over the negativity the story has brought.

I dunno something doesn't sit right with me about a guy in a well off job who seems to be holidaying to festivals on the back of a photopass gaining so much support by randomers online by the misuse of a photo on a social media site by a small scale business. Not illogical they'd want to have him banned from shows due to the bad experience...of course it's rash but if that's their decision...but when it became public like that AE needed to get some proper PR advice than having their former and current singers continue to expose themselves as utterly brainless individuals.

Very different story/set of circumstances to this though. And the singer guy has a bit of a rep for screwing people anyway if I remember?
